This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our HubSpot-hosted pages at info.prosperityta.com (the "Site") or submit a consultation request through these pages. Other Prosperity websites publish their own notices. This notice does not retroactively expand the use of information collected under an earlier notice.

Please read this policy carefully. If you disagree with any of its terms, please discontinue use of the Site and our services.

2.3 Information from Third Parties

  • Information from scheduling tools, payment processors, and analytics providers

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, operate, and improve our tax advisory services
  • To communicate with you about your account, appointments, and tax matters
  • To send you marketing communications, including SMS messages, where you have expressly opted in
  • To personalize your experience on the Site
  • To process payments and prevent fraud
  • To comply with legal obligations, including IRS and state tax regulations
  • To analyze usage trends and improve our website and services
  • To measure advertising and improve ad delivery using the limited advertising data described in Section 6.1, subject to your choices and applicable requirements

4. SMS / Text Message Communications

4.1 Consent and Opt-In

We send text messages only to individuals who have expressly opted in to receive them. You may opt in by checking the SMS consent box when you book a consultation or meeting with our team through the scheduling form on prosperityta.com or thinkwealth.tax. This box is unchecked by default, and you must affirmatively select it to receive text messages.

Consent to receive text messages is not a condition of booking a consultation, of purchase, or of receiving any of our services. If you provide your phone number when booking but do not check the SMS consent box, we will not send you text messages.

4.2 Program Description

By opting in, you consent to receive SMS messages from Prosperity Tax Advisors regarding appointment reminders, tax strategy updates, account and filing notifications, promotional offers, and general service information.

Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

4.3 Opt-Out

You may cancel the SMS service at any time by replying STOP to any message you receive from us. After you send STOP, we will send a confirmation message and you will receive no further text messages from us. To rejoin, opt in again using the method described above.

4.4 Help

For assistance, reply HELP to any message from us, or contact us at info@prosperityta.com or 813-937-9221.

4.5 Mobile Information and Opt-In Data: No Sharing

No mobile information will be sold, shared, rented, released, or traded with third parties or affiliates for marketing or promotional purposes.

All of the categories of sharing described in Section 6 of this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, including service providers, affiliates, or any party in connection with a merger, acquisition, or sale of assets.

Mobile phone numbers collected for SMS purposes are disclosed only to our SMS delivery provider, and solely for the purpose of transmitting messages to you. They are used for no other purpose.

5. Data We Do Not Sell

We do not exchange personal information for money. Our advertising disclosures and choices are explained in Sections 6.1 and 9; advertising sharing may be treated as a sale or sharing under some privacy laws. We do not sell, share, rent, release, or trade mobile information or SMS opt-in data for any marketing or promotional purpose.

6. Disclosure of Your Information

Subject to the SMS exclusions stated in Section 4.5, we may share your information in the following circumstances:

  • Service Providers: Trusted vendors (for example, HubSpot, payment processors, and scheduling software) who assist us in operating our business, subject to confidentiality agreements and permitted to use the information only to perform services for us.
  • Legal Requirements: When required by law, subpoena, court order, or governmental authority.
  • Protection of Rights: To protect the rights, property, or safety of Prosperity Tax Advisors, our clients, or others.
  • Business Transfers: In connection with a merger, acquisition, or sale of assets, with prior notice to you.

Text messaging originator opt-in data and consent are excluded from every category above and will not be shared with any third party.

6.1 Advertising measurement and Meta

We use Meta Pixel and Conversions API, through HubSpot and our booking integration, to measure advertising and improve ad delivery. Subject to your choices and applicable requirements, we share limited website activity, inquiry and appointment-booking events with Meta. These can include event times, website addresses with unnecessary details removed, browser and device information, IP addresses where available, advertising click and cookie identifiers, and matching identifiers derived from your email address, name or CRM record. Contact matching identifiers are hashed where required; hashing does not make information anonymous. Meta can match events to its users and use them for advertising measurement and delivery under its own policies.

These advertising events exclude mobile phone numbers, SMS consent and message records, tax returns, income and tax-bill amounts, financial account details, application answers and consultation notes. Agreeing to receive SMS, accepting terms or requesting a consultation is not a separate grant of advertising consent. Your advertising choice does not prevent you from requesting or booking a consultation.

7. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes outlined in this policy, maintain our business relationship with you, comply with legal and regulatory obligations (IRS records retention requirements may require us to retain tax-related data for up to seven years), and resolve disputes.

You may request deletion of your personal information at any time by contacting us at info@prosperityta.com, subject to the legal retention requirements described above.

8. Cookies and Tracking Technologies

We use cookies, web beacons, and similar technologies to enhance your experience on our Site. You can control cookie settings through your browser, though disabling cookies may affect Site functionality. We may use:

  • Essential cookies: Necessary for the Site to function properly
  • Analytics cookies: Help us understand how visitors interact with the Site (for example, Google Analytics)
  • Marketing cookies: Used by HubSpot and other tools to deliver relevant content and track campaign performance

9. Your Rights and Choices

Depending on your location, you may have the following rights:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate information
  • Deletion: Request deletion of your personal information, subject to legal retention requirements
  • Opt-Out: Opt out of marketing communications at any time by clicking "Unsubscribe" in emails, replying STOP to SMS messages, or contacting us directly
  • Data Portability: Request transfer of your data in a structured format

Advertising privacy choices: To request an opt-out of advertising sale or sharing, email info@prosperityta.com or call 813-937-9221. Identify the email address associated with your inquiry so we can apply your request to the correct record. Do not include tax documents, financial account information or other sensitive details in a privacy request. Email requests require our team to process them; opening the email link does not itself change your browser settings.

Where a cookie preferences control is available, you can also use it to manage browser-based tracking. Browser settings and recognized opt-out signals, including Global Privacy Control where applicable, may affect tracking. A browser choice may not identify a contact record or apply to another device; contact us to request account-level changes. Declining advertising sharing does not prevent consultation booking. To exercise access, correction, deletion or portability rights, contact info@prosperityta.com.

10. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, including the right to know what personal information is collected, the right to delete personal information, the right to correct inaccurate personal information, and the right to opt out of the sale or sharing of personal information.

Our use of advertising tools as described in Section 6.1 may constitute sharing for cross-context behavioral advertising under California law. You may request an opt-out of sale or sharing using the choices in Section 9. Mobile information and SMS opt-in data remain excluded from advertising sharing. We will not discriminate against you for exercising your privacy rights.

11. Children's Privacy

Our Site and services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us immediately at info@prosperityta.com and we will delete it.

12. Security

We implement industry-standard technical and organizational measures, including encryption in transit, access controls, and vendor confidentiality agreements, to protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

13. Links to Third-Party Sites

Our Site may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policy of any third-party site you visit.

14. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of material changes by updating the "Last Updated" date at the top of this policy and, where appropriate, by sending you a direct notification. Your continued use of our services after changes become effective constitutes acceptance of the updated policy.
